Illinois Tollway personnel are not responsible or expected to assist the bidder in loading or preparing any item(s) for transportation. Upon receipt of the item (by the bidder or bidders agent), the item(s) is considered the property of the bidder and any damage or harm to the item once the property has changed hands is the bidders responsibility.

All sales are final and no refunds will be given. This transaction shall be governed by the laws of the State of Illinois. Any disputes hereunder will be heard in the 18^th Judicial Circuit Court of DuPage County.

The provision noted herein contains the entire agreement between the parties and supersedes and replaces all such prior agreements with respect to matters expressly set forth herein. No modification shall be made to this agreement except in writing and agreed to by the Illinois Tollway. This agreement shall be binding upon the parties and their respective heirs, executors, administrators, successors, assigns and personal representatives.

The Illinois Tollway reserves the right, at its absolute discretion, to reject any and/or all bids and payments and cancel any sales considered as not in its best interest up to time of delivery. The Illinois Tollway also reserves the right to withdraw an item at any time - including during the bidding process.

Bidding Information:

Bidders bidding on this item are entering into a Contractual Agreement to purchase the item and are bound to the terms outlined herein. Bidders must be a minimum of 18 years of age.

This item is offered by the Illinois Tollway and all conditions set forth herein shall apply to this sale and other sale conditions set by CMS may apply. Viewing of vehicles and equipment offered by the Illinois Tollway Fleet Unit is by appointment only. Viewing Information is as follows:

Directions:

- Finley Road is ½ block east of I355 at Butterfield Rd, From Butterfield Rd turn south on Finley 2 miles to Central Shop. Central Shop is on west side of Finley Rd. Follow signs once on property

- From Chicago, take I290 to I88 west to Highland Ave., Go north on Highland to Butterfield Road, Butterfield west to Finley, south on Finley 2 miles to Tollway’s Central Shop. Follow signs once on property.

- From north or south take I355 to Butterfield road. Go east to Finley, Take Finley south to Tollway’s Central Shop. Follow signs once on property.

PAYMENT IS TO BE MADE VIA CREDIT CARD. THE ILLINOIS TOLLWAY WILL VERIFY THE VALIDITY OF ALL CARD TRANSACTIONS BEFORE RELEASING THE ITEM(S). PAYMENT MUST BE MADE WITHIN 5 BUSINESS DAYS OF THE SALE - OR THE SALE MAY BE CANCELLED. CREDIT CARDS CHARGES MUST CLEAR AND POST PAYMENT TO THE TOLLWAY (USUALLY 12-24 HOURS) BEFORE ITEM WILL BE RELEASED.

 NOTE: Bidders that do not meet the payment terms outlined herein will be charged a minimum relisting fee of $250.00 and 10% of the defaulting bidder's highest bid as a restocking fee and are subject to collection services and expenses.

All items must be picked up within 20 days of payment. If a item(s) is not picked up within 20 days, the buyer will forfeit payment for said item(s) as liquidated damages. The Illinois Tollway reserves the right thereafter to re-auction or scrap the item(s), for failure to comply with pick up procedures as stated herein.

In the event the winning bidder defaults on the payment for the items offered herein, the Tollway may at its sole discretion award the sale to the next highest bidder.  The newly awarded bidder will therefore be bound to the terms of the sale beginning the day the new award is made.   

Tollway will e-mail a copy of the IBid bill of sale to the successful bidder. Bidder or bidder’s agent must produce copy of IBid bill of sale when picking up an item(s). Buyer's are required to present a drivers license at time of pick-up.

Pick up times for all Illinois Tollway Fleet IBid items are Monday – Friday 9:00 AM until 2:00 PM (except all State Holidays). Illinois Tollway personnel are not responsible or expected to assist the bidder in loading or preparing any item(s) for transportation. Upon receipt of the item (by the bidder or bidders agent), the item(s) is considered the property of the bidder and any damage or harm to the item once the property has changed hands is the bidders responsibility.

All sales are final and no refunds will be given. The Illinois Tollway may, without liability, delay performance or cancel this sale on account of force majeure events or other circumstances beyond its control, including, but not limited to, strikes, acts of God, political unrest, embargo, failure of source of supply, or casualty.

Buyer accepts the item(s) or equipment “As Is” & “With All Faults”.No warranty, express or implied, is made by Seller, and none shall be imputed or presumed. Bidders are encouraged to have the item(s) safety inspected by a qualified professional before using the item.  Item(s) may have undisclosed damage or operational issues that are not noted in this posting or not known to the Tollway at the time of the sale. The Tollway shall have no responsibilty to repair or replace any item(s) that affect the physical condition of the item(s) in this sale.    

All sales taxes, tariffs, and other governmental charges shall be paid by Buyer and are Buyer's responsibility except as limited by law. This transaction shall be governed by the laws of the State of Illinois. Any disputes hereunder will be heard in the 18^th Judicial Circuit Court of DuPage County.

The provision noted herein contains the entire agreement between the parties and supersedes and replaces all such prior agreements with respect to matters expressly set forth herein. No modification shall be made to this agreement except in writing and agreed to by the Illinois Tollway. This agreement shall be binding upon the parties and their respective heirs, executors, administrators, successors, assigns and personal representatives.

The Illinois Tollway reserves the right, at its absolute discretion, to reject any and/or all bids and payments and cancel any sales considered as not in its best interest up to time of delivery. The Illinois Tollway also reserves the right to withdraw an item at any time - including during the bidding process.

Illinois Tollway Directors, officers, employees, consultants, their spouses, children or any person having any direct involvement with the disposition of Illinois Tollway surplus property may not bid on Illinois Tollway property at the CMS IBID website. Furthermore, employees of the State of Illinois Department of Central Management Services or any other person possessing personal or first-hand information regarding the condition of any item available for auction on the iBid Illinois site is prohibited from bidding on any Illinois Tollway property for auction on the IBid Illinois site

At the Illinois Tollway’s discretion, bidders may be disabled and barred from participation in future Illinois Tollway sales for any of the following:

1. Failure to observe these Terms and Conditions
2. Failure to make good and timely payment for the item(s) awarded.
3. Failure to claim purchases.
4. Intentional disruption of the auction process.

Registered users may be disabled from participation in State of Illinois Department of Central Management Services sales for any of the following:

1. Suspicious registration information.
2. Incomplete registration information

** DUE TO LIMITED WAREHOUSE SPACE, starting 12/4/17, failure to make payment and pick up property within five (5) government working days shall subject the winning bidder to the following:

          A) Illinois Department of Central Management Services has sole discretion, reclamation of the awarded property and relisting of the same for public auction.

          B) The payment of such fees and charges including any storage, administrative or other expenses necessary to re-auction the unclaimed item.

          C) Handling charge of $25.00 per item, plus ten percent (10%) of the bid price for a restocking fee.

          D) Failure to pay and/or pick up will result in bidder banned from the iBid website.

 THE ILLINOIS DEPARTMENT OF CENTRAL MANAGEMENT SERVICES WILL NOT PERMIT DELINQUENT PAYMENT OR PICKUP OF IBID MERCHANDISE. ALL UNPAID/UNCLAIMED ITEMS WILL BE RESOLD AND ABOVE PENALTIES SHALL BE IMPOSED ON DELINQUENT BIDDER. WHEN BIDDER MAKES PAYMENT BUT FAILS TO PICK-UP AWARDED PROPERTY WITHIN 5 BUSINESS DAYS, BIDDER SHALL ONLY BE ENTITLED TO A REFUND, LESS THE ABOVE PENALTIES ENUMERATED ABOVE.
